General Terms and Conditions

Preamble

These General Terms and Conditions (GTC) apply to all products sold by Neamedia on the neamedia-icons.com website.

Any order placed on the neamedia-icons.com website constitutes the formation of a contract concluded remotely between the Customer and Neamedia and necessarily implies the Customer’s irrevocable agreement, without restriction or reservation, with these general conditions of sale. Any conditions to the contrary imposed by the buyer and in the absence of an express agreement are unenforceable.

These conditions are subject to change at any time without notice.

ARTICLE 1 – ARTICLE AND AVAILABILITY

The Customer is invited to refer to the description of each product to find out about the properties and particularities. Any order implies acceptance of the price and characteristics of the products. The Customer has the possibility to check and validate his basket before proceeding to the payment of his order.

A sale is considered final only after the confirmation of acceptance of the order has been sent by e-mail and after the Seller has received the full price.

Stock outages

The items presented in the store are available for sale unless there is an indication of a temporary or permanent outage and unless a pre-order is placed as defined below.

In case of temporary stock outage:

The products presented for sale might be temporarily out of stock. In that case, a restocking is in progress and delivery deadlines are likely to be increased. The page of the product in question will explicitly mention the stock outage and the increase in delivery time.

In the event of a permanent outage of a product:

In the event of a permanent stock outage of a product already ordered on neamedia-icons.com: The Seller will offer the Customer an exchange or refund.

Non-completion of the project:

It is possible that the products offered for pre-order by the Seller are ultimately not available for sale (for example: the project is cancelled). The Seller shall notify the customer that it will not be able to fulfill the pre-orders. The Seller shall refund the Customer in full.

Click and Collect

The Customer can collect their order free of charge from our premises using the Click and Collect option, subject to available stock. Collection is possible as soon as confirmation is sent by email.

Pre-Orders

Operation:

The Seller may offer pre-order products. Pre-sales offered on the neamedia-icons.com website are open to all customers – unless otherwise specified. The date and duration of each pre-sale are specified. These operations may also be subject to certain limitations, such as the number of products authorized per customer.

Prices and payment:

Unless otherwise indicated, the price of products offered for pre-sale does not change when they are officially released. In case of a pre-order (order of an item in pre-sale), payment for the selected item is made at the time of ordering.

Delivery times:

The Seller undertakes to deliver the items pre-ordered by the Customer no later than thirty (30) days after the official release of the pre-ordered product. The official release date is indicated on the page about each pre-order product and is subject to change.

Information:

It is possible that some pre-ordered products might be subject to some changes (appearance, deadlines). In this case, it will be explicitly noted on the product sheet that it may be subject to change. The Seller will notify the Customer of any change concerning his pre-order by email.

ARTICLE 2 – PRICES

Prices are indicated in euros and include VAT (inclusive of tax), excluding shipping costs. All orders are invoiced and payable in euros. All products destined for France or the European Union are subject to 20% VAT according to the law. The price does not include the delivery costs invoiced in addition and which is indicated on the order confirmation page. The calculation of delivery costs is done once the Customer’s address has been entered.

Orders and pre-orders are payable in full and in one payment. The Seller shall not be obliged to deliver the products ordered by the Customer if the amount has not been paid in full in advance. Product offers are valid as long as they are visible on the site, within the limits of available stocks. The Seller reserves the right to change the prices at any time.

Sales:

The Seller may offer sales twice a year in accordance with the dates set by the Paris & Ile-de-France prefecture.

Promotions:

The Seller offers promotions all year round on selected products, within set dates. Under no circumstances can the Customer benefit from these promotions outside these periods.

Promotional Codes:

The Seller may offer their customers promotional codes as part of special operations. These promotional codes are limited in time or do not apply to certain products, to a certain number of uses per customer, or to the payment of shipping costs.

ARTICLE 3 – SHIPPING COSTS

Shipping costs indicated on the neamedia-icons.com website, are expressed inclusive of VAT (inclusive of tax). These costs are to be borne by the Customer and are invoiced in addition to the price of the products ordered. The Customer will be informed before the final validation of his order of the delivery costs related to his order and payment will be requested from the Customer for the total amount of the purchase (price of the products as well as the delivery costs calculated for the address given on this same page).

Shipping costs include a contribution towards the costs of preparation, packaging and postage. They are at a flat rate, composed of a fixed part and a part that depends on the weight of the items ordered.

The neamedia-icons.com online store uses a module that allows the Customer to save time by automatically filling in his address from the first field filled in (building number and street). It is the Customer’s responsibility to verify this information. Otherwise, the Seller shall not be held liable.

The geographical area and shipping method chosen when an order is placed causes the total amount shown on the screen to vary.

 

ARTICLE 4 – PAYMENT

Several payment options are available to the Customer:

  1. Secure payment by credit card (Carte Bleue, Visa, Eurocard/Mastercard). Stripe solution.
  2. Secure payment by PayPal

1) Secure payment by credit card

The Customer must indicate the number of his credit card, its validity date and the 3-digit cryptogram on the back, in the area provided for this purpose (secure entry by SSL encryption).

This payment is secured by Stripe.

2) Secure payment by PayPal

The Customer can pay for his order through his PayPal account. After validation of the basket, the Store will redirect payment to the secure PayPal payment page.

Orders and pre-orders are payable in full and in one payment or in 4 instalments without fees via PayPal.

If the Customer does not have a PayPal account, he can also use the PayPal payment function without creating an account, by entering his credit card information on the payment page.

ARTICLE 5 – DELIVERY

The geographical delivery area corresponds to the geographical coverage area of the offer. In the event of a request for delivery outside these areas, the Seller reserves the right to deviate from the following conditions.

For products that weigh less than 10 kg

The products purchased by the Customer will be delivered within a maximum period of thirty (30) days following the day of the order to the address indicated by the Customer when the order is placed on the neamedia-icons.com website, unless expressly stated otherwise. In the event that this deadline is exceeded, and this is not justified by a case of force majeure, the Customer may request the cancellation of the sale under the conditions provided in Article L. 114-1 of the Consumer Code and can obtain a refund of the sums paid at the time of the sale.

Deliveries are made by an independent carrier. The Seller recommends that the Customer checks the condition of the products delivered before signing the acknowledgement of receipt of the package.

If he notices any anomalies (damage, missing product, exterior of the package damaged, abnormal noise, broken product(s), etc…), the Customer must refuse delivery of the products and communicate handwritten, precise and dated reservations. These reservations must be confirmed with the carrier by registered letter with acknowledgement of receipt within three (3) working days following the delivery of the products. A copy will be sent to Neamedia, 71 rue du Faubourg Saint Antoine 75011 Paris, FRANCE or by email to the following address: client[@]neamedia-icons.com.

After this period and if there is failure to comply with these formalities, the products will be deemed to be in conformance and free of any apparent defect and no claim can be validly accepted by the Seller.

As soon as possible and at its own expense, the Seller shall replace the delivered products for which apparent defects or lack of conformity have been duly proven by the Customer.

In case of return due to a delivery error (wrong color of product or different size for example), any non-conforming product must be returned in its entirety and in its original packaging to: Neamedia, 71 rue du Faubourg Saint Antoine, 75011 Paris, France. Upon receipt, the Seller shall send the product that was initially ordered.

If it is no longer available, the Customer will be refunded the amount paid within thirty (30) days of receipt of the non-conforming product. The return of the non-conforming product will be the responsibility of the Seller.

It is the Customer’s responsibility to verify the accuracy of the delivery information (name, address, contact information). Otherwise, the Seller shall not be held liable.

For any delivery outside Metropolitan France, the Customer may have to pay customs duties, VAT or other taxes due on the importation of the products into the country of delivery. The formalities relating to them are also the exclusive responsibility of the Customer, unless otherwise specified. The Customer is considered to be the importer of the product and is therefore solely responsible for verifying whether and under what conditions the law of the country of delivery allows the importation of the products ordered.

If the Customer refuses or does not pay customs duties, the product will be considered abandoned by the Customer and no refund can be offered by the Seller.

The Customer is considered to be responsible for the reception of the product. If it has not been recovered within the time limits set by the carrier, it will automatically be returned to the Seller.

If the Customer wishes to receive his package again, he has fourteen (14) days to inform the Seller in writing (email to: client@neamedia-icons.com, or mail to: Neamedia, 71 rue du Faubourg Saint Antoine, 75011, Paris). He will then be required to send a check drawn on a bank in France or a bank transfer for the amount of shipping costs initially incurred during the validation of the order. The Seller’s bank details will be communicated in return. Otherwise, the Customer will be refunded the amount paid, less delivery costs.

Delivery may not be possible to all countries depending on the agreements reached with rights holders.

ARTICLE 6 – PRODUCT QUALITY

The items provided by the Seller on the neamedia-icons.com online stores are new.

In case of receipt of a defective product, please return the damaged product to Neamedia, 71 rue du Faubourg Saint Antoine 75011 Paris, within fifteen (15) days after receipt of the order, the date of dispatch being proof. After this period, no request can be processed.

In any event, the products sold benefit from the legal guarantee against hidden defects according to articles 1641 et sequens of the Civil Code.

The descriptions, information and photographs presenting the products are provided for illustrative purposes only and have no contractual value. Each product sold on the neamedia-icons.com website is unique and manufactured in a traditional way. It is therefore common for there to be variations between products (lining, color, varnish, etc.). These points cannot be invoked for any after-sales service after receipt of the product by the Customer.

In case of a pre-order:

The Seller may at times offer pre-order products. In that case, the products presented in the store might subject to modification. The Customer will be informed directly by email of any changes.

ARTICLE 7 – RIGHT TO RETRACT

The Customer has the right to return the product ordered within fourteen (14) working days of the day after the delivery of his order.

This right to exchange or to receive a refund for products that do not suit him, is at his costs, in accordance with Article L 121-16 of the Consumer Code.

If this period expires on a Saturday, Sunday, a public holiday or non-working day, it is extended until the next working day.

The returned product must be in its original condition and packaging. It must not have been used or subjected to any damage, however slight, and must be perfectly clean. This right to retract is exercised without penalty. The return costs are the responsibility of the Customer.

The Customer will be reimbursed for the sums paid within a maximum of fourteen (14) days of receipt of the product. The Seller will use the same payment method as the one used by the Customer when paying for his order. If this is not possible, the Customer will provide the Seller with his bank details.

To exercise his right to retract, the Customer must send the retraction form to the Seller, to Neamedia 71 rue du Faubourg Saint Antoine 75011 Paris, FRANCE or by email to the following address: client@neamedia-icons.com.

Consequences of the right to retract:

In the event of retraction from this contract, the Seller shall refund all sums paid (including the initial delivery costs) upon receipt of the goods or when the Customer has provided proof of shipment, whichever is earlier.

The Customer is then required to return the goods to Neamedia, 71 rue du Faubourg Saint Antoine, 75011 – Paris, France, without undue delay and in any event, no later than fourteen (14) days after having informed the Seller of their decision to retract. This deadline is deemed to have been met if the property is returned before the expiry of the fourteen (14) day deadline (proof of dispatch being required).

The Customer is only liable for the depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the goods.

Exception to the right to retract:

The exercise of the right to retract is excluded for contracts for the supply of goods made to the consumer’s specifications or clearly personalized.

ARTICLE 8 – TRANSFER OF OWNERSHIP – TRANSFER OF RISK

The ordered products remain the exclusive property of the Seller until final and full payment of their price in accordance with the terms of Law No. 80 335 of 12 May 1980.

The Seller reserves the right to claim the ordered products in the event of non-payment. In that case and at the Seller’s first request, the Customer undertakes to pay the amount due or any unpaid product, and the remaining shipping costs are to be borne by the Customer.

Ownership of the products will only be transferred to the Customer after full payment of the price by the Customer, regardless of the delivery date of the said products.

On the other hand, the risk of loss and deterioration of the products will be transferred to the Customer upon delivery and receipt of the said products by the Customer.

ARTICLE 9 – RIGHT OF ACCESS AND RECTIFICATION

Deontology

The neamedia-icons.com online store attaches the utmost importance to the secure processing of your data. During the purchase, the Seller only requests the essential information (surname, first name, address, email, telephone number) from his Customer for good quality treatment and a careful follow-up of his order.

Personal data may nevertheless be transmitted to third parties, partners of the neamedia-icons.com online store such as their delivery service providers or the online payment platforms provided (PayPal, OGONE). With regard to information concerning him, under the conditions provided for by the Data Protection Act of 6 January 1978, the Customer has a right of access, modification, rectification and opposition by contacting Customer Service by e-mail to client[@]neamedia-icons.com or by modifying his information directly from the Privacy Settings page on the neamedia-icons.com website.

Depending on the choices made by the Customer when creating or consulting his account, he may receive offers from Neamedia. If he no longer wishes to do so, he may at any time make a request to that effect via the Privacy Settings page, by using an unsubscribe link provided by the Seller or by writing to: client@neamedia-icons.com.

By adhering to these general terms and conditions of sale, the Customer agrees that the Seller may collect and use his data for the execution of this contract.

The Seller tracks traffic on all its sites, using tools such as Google Analytics.

Cookies:

Cookies store certain information in the memory of the hard drive. Under no circumstances do cookies contain confidential information such as a name, credit card number… but they do make it possible to keep in memory the articles that the Customer has selected during his previous visits and the pages on which he has navigated. An alert message asks the Customer in advance if he wishes to accept cookies, which he is of course free to refuse. The Customer also has the possibility to delete these cookies directly from his web browser. The Customer has the possibility to manage his cookies from the Privacy Settings page, which is accessible from the information menu in the footer of the site. The use and list of cookies can also be viewed at the same address.

ARTICLE 10 – LIABILITY

The products on offer comply with current French legislation. The Seller declines all responsibility in the event of non-compliance by the delivered item with the legislation of the country of delivery (censorship, prohibition of a title or author…)

The Seller shall not be held liable in the event of non-performance of the contract or delay or impossibility of delivery due to force majeure (strike, flood, fire…). The Seller is not responsible for the content of external sites to which hypertext links may refer from their own site.

The occurrence of an unpaid debt due to fraudulent authorization of a credit card and/or irregular or misleading statements by the Customer will result in the registration of his details in a payment incident file.

ARTICLE 11 – APPLICABLE LAW

All the clauses appearing in these general terms and conditions of sale, as well as all the purchase and sale operations referred to therein, shall be subject to French law. The Courts will be those of the Neamedia headquarters (PARIS) where the contract between the parties is formed.
