Terms and Conditions of Sale

Preamble

These General Terms and Conditions of Sale (GTC) apply to all products sold by Neamedia on the neamedia-icons.com website.

Any order placed on the neamedia-icons.com website constitutes the formation of a distance contract between the Customer and Neamedia and necessarily implies the Customer's irrevocable acceptance, without restriction or reservation, of these general terms and conditions of sale. Any contrary conditions imposed by the buyer and in the absence of express agreement are unenforceable.

The Customer: The term customer refers to the co-contracting party of the company Neamedia.

The Seller: The term The Seller refers to the company Neamedia through the neamedia-icons.com website.

These conditions are subject to change at any time without prior notice.

ARTICLE 1 – ITEM AND AVAILABILITY

The Customer is invited to refer to the description of each product to learn about its properties and specificities. Any order implies acceptance of the price and characteristics of the products. The Customer has the possibility to check and validate their cart before proceeding to payment of their order.

A sale is only considered final after the sending of the order acceptance confirmation by email and after the Seller has received full payment of the price.

Out of stock

The items presented in the shop are available for sale unless indicated as temporarily or definitively out of stock and except in the case of pre-orders defined below.

In case of temporary out of stock:

It is possible that products offered for sale are temporarily out of stock. In this case, a production restock is underway and delivery times may be extended. The product page in question will explicitly mention the out of stock status and the increased delivery time.

In case of permanent out of stock for a product:

In case of permanent out of stock for a product already ordered on neamedia-icons.com: The Seller will offer the Customer an exchange or a refund.

Project not completed:

It is possible that products offered for pre-order by the Seller may ultimately not be available for sale (e.g., project cancelled). The Seller will notify the customer that they will not be able to fulfill the pre-orders. The Seller will fully refund the customer.

Click and Collect

The customer has the option to collect their order for free from our premises using the Click and Collect option, subject to stock availability. Collection is possible upon email confirmation of availability.

Pre-orders

How it works:

The Seller may offer products for pre-order. Pre-sales offered on the neamedia-icons.com website are open to all customers – unless special conditions apply. The date and duration of each pre-sale are specified for each of them. These operations may also be subject to certain limitations, such as the number of products allowed per customer.

Price and payment:

Unless otherwise indicated, the price of products offered for pre-sale does not change upon their official release. In the case of a pre-order (order of an item in pre-sale), payment for the selected item is made at the time of the order.

Delivery times:

The Seller undertakes to deliver pre-ordered items to the Customer no later than thirty (30) days after the official release of the pre-ordered product. The official release date is indicated on the presentation page of each pre-ordered product.

Information:

It is possible that some pre-ordered products may be subject to some changes (appearance, delays). In this case, it will be explicitly noted on the product sheet that the product may be subject to changes. The Seller will notify the Customer of any changes regarding their pre-order by e-mail.

ARTICLE 2 – PRICE

Prices are indicated in euros and include all taxes (TTC), excluding shipping costs. All orders are invoiced and payable in euros. All products intended for France or the European Union are subject to a VAT of 20% as provided by law. The price does not include delivery costs, which are billed in addition and will be indicated on the order confirmation page.

Orders and pre-orders are payable in full. The Seller will not be obliged to deliver the products ordered by the Customer if the amount has not been paid in full in advance. Product offers are valid as long as they are visible on the site, within the limits of available stock. The Seller reserves the right to modify prices at any time.

Sales:

The Seller may offer sales twice a year in accordance with the dates set by the prefecture of 75.

Promotions:

The Seller offers promotions throughout the year on selected products, framed by specific dates. Under no circumstances can the Customer benefit from these promotions outside of these periods.

Promotional Codes:

The Seller may offer promotional codes to its customers as part of special operations. These promotional codes are time-limited or apply to certain products, a certain number of uses per customer, or cover shipping costs.

ARTICLE 3 – SHIPPING COSTS

The shipping costs indicated on the neamedia-icons.com website are expressed inclusive of all taxes (TTC). These costs are the responsibility of the Customer and are invoiced in addition to the price of the products ordered. The Customer will be informed of the delivery costs related to their order before final validation of their order, and payment will be requested from the Customer for the total amount of the purchase.

Shipping costs include a contribution to preparation and packaging costs and postage.

It is the Customer's responsibility to check their delivery information. Otherwise, the Seller cannot be held responsible.

The shipping method chosen during the order varies the total amount displayed on the screen.

ARTICLE 4 – PAYMENT

Several payment options are available to the Customer:

  1. Secure payment by credit card (Carte Bleue, Visa, Eurocard/Mastercard). Shopify Payment solution via Stripe.
  2. Secure payment by Paypal

1) Secure payment by Credit Card

The Customer must provide their credit card number, its validity date, and the 3-digit security code on the back, in the designated area (secure entry via SSL encryption).

This payment is secured by the Shopify Payment service via Stripe.

2) Secure payment by Paypal

The Customer can pay for their order using their Paypal account. After validating the cart, the Shop will redirect them to the secure Paypal payment page.

Orders and pre-orders are payable in full and in a single payment or in 4 interest-free installments via PayPal.

If the Customer does not have a Paypal account, they can also use the Paypal payment function without creating an account, by entering their credit card information on the payment page.

ARTICLE 5 – DELIVERY

The geographical delivery area corresponds to the geographical coverage area of the offer.

Delivery zones are as follows:

France, Belgium, Germany, Italy, Spain and United Kingdom

For other countries, please contact us directly, we will try to find a solution to deliver our creations to you.

In the case of a delivery request outside these zones, the Seller reserves the right to derogate from the following conditions.

The products acquired by the Customer will be delivered within a maximum of thirty (30) days following the day of the order to the address indicated by the Customer when ordering on the neamedia-icons.com website, unless expressly stated otherwise. If this deadline is exceeded and not justified by a case of force majeure, the Customer may request the cancellation of the sale under the conditions provided for in article L. 114-1 of the Consumer Code and obtain a refund of the sums paid during the sale.

Deliveries are carried out by an independent carrier. The Seller recommends that the Customer check the condition of the delivered products before signing the delivery receipt.

If anomalies are noted (damage, missing product, damaged package exterior, abnormal noise, broken product(s), etc.), the Customer must refuse delivery of the products and make handwritten, precise and dated reservations. These reservations must be confirmed to the carrier by registered letter with acknowledgment of receipt within three (3) working days following the delivery of the products. A copy will be sent to Neamedia, 71 rue du Faubourg Saint Antoine 75011 Paris, FRANCE or by e-mail to the following address: client@neamedia-icons.com.

After this period and in the absence of compliance with these formalities, the products will be deemed to conform and be free from any apparent defect, and no claim can be validly accepted by the Seller.

The Seller will replace, as soon as possible and at its own expense, the delivered products whose apparent defects or non-conformities have been duly proven by the Customer.

In case of return following a delivery error (wrong product color or different size for example), any non-conforming product must be returned in its entirety and in its original packaging to: Neamedia, 71 rue du Faubourg Saint Antoine, 75011 Paris, France. Upon receipt, the Seller will send the product initially ordered.

If it is no longer available, the Customer will be refunded the amount paid within thirty (30) days from the receipt of the non-conforming product. The return of the non-conforming product will be at the Seller's expense.

It is the Customer's responsibility to verify the accuracy of the delivery information (name, address, contact details). Otherwise, the Seller cannot be held responsible.

For any delivery outside Metropolitan France, the Customer may have to pay customs duties, VAT or other taxes due to the importation of the products into the country of delivery. The related formalities are also the sole responsibility of the Customer, unless otherwise indicated. The Customer is considered the importer of the product and is therefore solely responsible for verifying the possibility of importing the ordered products with regard to the law of the territory of the country of delivery.

If the Customer refuses or does not pay the customs duties, the product will be considered abandoned by the Customer and no refund can be offered by the Seller.

The Customer is considered responsible for receiving the product. If it has not been collected within the timeframe specified by the carrier, it will be automatically returned to the Seller.

If the Customer wishes to receive their package again, they have fourteen (14) days to inform the Seller in writing (email to client@neamedia-icons.com, or mail to Neamedia, 71 rue du Faubourg Saint Antoine, 75011, Paris). They will then be required to send a bank transfer for the amount of the shipping costs initially incurred when validating the order. The Seller's bank details will be communicated in return. Otherwise, the Customer will be refunded the amount paid, minus delivery costs.

Delivery may also not be possible in all countries, depending on agreements with rights holders.

ARTICLE 6 – PRODUCT QUALITY

The items supplied by the Seller on the neamedia-icons.com online store are new.

In case of receipt of a defective product, please return the damaged product to Neamedia, 71 rue du Faubourg Saint Antoine 75011 Paris, within fifteen (15) days after receipt of the order, the date of shipment being proof. Beyond this period, no request can be processed.

In any event, the products sold benefit from the legal guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code.

The descriptions, information, and photographs presenting the products are provided for illustrative purposes and have no contractual value. Each product sold on the neamedia-icons.com website is unique and handcrafted. It is therefore common for there to be variations between products (lining, color, varnish, etc.). These points cannot be invoked for any after-sales service claim after receipt of the product by the Customer.

In case of pre-order:

The Seller may offer products for pre-order. In this case, it is possible that the products presented in the store may be subject to modification. The Customer will be informed directly by e-mail of any changes.

ARTICLE 7 – RIGHT OF WITHDRAWAL

The Customer has a right of return within fourteen (14) working days from the day after delivery of their order.

This right of return is at their expense, for exchange or refund of products that do not suit them, in accordance with article L 121–16 of the Consumer Code.

If this period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended until the next working day.

The returned product must be in its original condition and packaging. It must not have been used or suffered any deterioration, however minor, and must be in a perfectly clean state. This right of withdrawal is exercised without penalty. Return shipping costs are borne by the Customer.

The Customer will be refunded the amounts paid within a maximum of fourteen (14) days from receipt of the product. The Seller will use the same payment method as that used by the Customer when paying for their order. If this is not possible, the Customer will provide the Seller with their bank details.

Consequences of the right of withdrawal

In the event of withdrawal from this contract, the Seller will refund all sums paid (including initial delivery costs), upon receipt of the goods or when the Customer has provided proof of shipment, the date taken into account being the first of these facts.

The Customer is then required to return or hand over the goods to Neamedia, 71 rue du Faubourg Saint Antoine, 75011 – Paris, France, without undue delay and, in any event, no later than fourteen (14) days after notifying the Seller of their decision to withdraw from this contract. This deadline is deemed to have been met if the goods are returned before the expiry of the fourteen (14) day period (proof of shipment being authentic).

The Customer's liability is only engaged with regard to the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods.

Exception to the right of withdrawal

The exercise of the right of withdrawal is excluded for contracts for the supply of goods made to the consumer's specifications or clearly personalized.

ARTICLE 8 – TRANSFER OF OWNERSHIP – TRANSFER OF RISKS

The ordered products remain the exclusive property of the Seller until final and full payment of their price in accordance with the terms of law no. 80 335 of May 12, 1980.

The Seller reserves the right to claim the ordered products in case of default of payment. In this event and upon first request from the Seller, the Customer undertakes to return the missing amount or any unpaid product, with shipping costs remaining at the Customer's expense.

The transfer of ownership of the products to the Customer will only take place after full payment of the price by the latter, regardless of the delivery date of the said products.

However, the transfer of risks of loss and deterioration of the products will take place upon delivery and receipt of the said products by the Customer.

ARTICLE 9 – RIGHT OF ACCESS AND RECTIFICATION

Ethics

The neamedia-icons.com online store places the utmost importance on the secure processing of your data. When making purchases, the Seller only requests essential information (first name, last name, address, email, telephone number) from the Customer for quality processing and careful tracking of their order.

However, personal data may be transmitted to third parties, partners of the neamedia-icons.com online store, such as its delivery service providers or the online payment platforms offered (PayPal, Shopify Payment via Stripe). Regarding their information, under the conditions provided by the Data Protection Act of January 6, 1978, the Customer has a right to access, modify, rectify, and object by contacting Customer service by email at client@neamedia-icons.com or by modifying their information directly from the Privacy Settings page on the neamedia-icons.com website.

Depending on the choices made by the Customer when creating or consulting their account, they may receive offers from Neamedia. If they no longer wish to do so, they can at any time request this via the Privacy Settings page, by using an unsubscribe link from the Seller's communications, or by writing to client@neamedia-icons.com.

By adhering to these general terms and conditions of sale, the Customer agrees that the Seller may collect and use their data for the performance of this contract.

The Seller monitors traffic on all its sites, for which it uses tools such as Google Analytics.

Cookies:

Cookies record certain information that is stored in the hard disk memory. Under no circumstances do cookies contain confidential information such as a name, credit card number, etc., but they do allow the system to remember the items the Customer has selected during previous visits and the pages they have browsed. An alert message first asks the Customer if they wish to accept cookies, which they are of course free to refuse. The Customer can also delete these cookies directly from their internet browser. The Customer can manage their cookies from the Privacy Settings page, accessible from the information menu in the website footer. The use and list of cookies can also be consulted at the same address.

ARTICLE 10 – LIABILITY

The products offered comply with current French legislation. The Seller disclaims all responsibility in the event that the delivered item does not comply with the legislation of the country of delivery (censorship, prohibition of a title or an author, etc.).

The Seller shall not be held liable for non-performance of the contract or for delay or impossibility of delivery due to a case of force majeure (strike, flood, fire, etc.). The Seller disclaims all responsibility for the content of external sites to which hyperlinks may refer from its own site.

The occurrence of an unpaid amount due to fraudulent authorization of a bank card and/or irregular or false declarations by the Customer will result in the registration of their contact details in a payment incident file.

ARTICLE 11 – APPLICABLE LAW

All clauses appearing in these general terms and conditions of sale, as well as all purchase and sale operations referred to therein, shall be subject to French law. The courts shall be those within the jurisdiction of Neamedia's headquarters (PARIS) where the contract between the parties is formed.
